Minimum wage per January 1, 2016

The statutory minimum wage will be increased by 1.11% on January 1, 2016. This will occur in accordance with the Wet Aanpak Schijnconstructies (Legal approach to Apparent Constructions, or WAS), which will apply new rules for the minimum wage.

The gross amounts of the Minimum Wage Act (WML) and the minimum holiday allowance per January 1, 2016 will be as follows:

€ 1,524.60 per month (previously € 1507.80 on July 1, 2015)
€ 351.85 per week
€ 70.37 per day

Minimum wage
Employees younger than 23 years old will be entitled to a fixed percentage of the gross minimum wage.

The statutory minimum youth wage per January 1, 2016 is:

22 years: € 1,295.90 per month (85%)

21 years: € 1,105.35 per month (72.5%)

20 years: € 937.65 per month (61.5%)

19 years: € 800.40 per month (52.5%)

18 years: € 693.70 per month (45.5%)

17 years: € 602.20 per month (39.5%)

16 years: € 526.00 per month (34.5%)

15 years: € 457.40 per month (30%)

Minimum Hourly wage

The gross minimum wage per hour for workers aged 23 and older in full-time employment will earn from January 1, 2016 respectively:

36-hour week: € 9.78 per hour

38-hour week: € 9.26 per hour

40-hour week: € 8.80 per hour

Stricter rules

Under the rules of the WAS, employers are subject to stricter rules regarding the minimum wage.

Employers must pay the full minimum wage: any structure in which the employer pay less than the whole minimum wage is prohibited. For example, when an employer improperly supplies meal costs or insurance costs.

Clearer payslips: They will also need to provide employees a clearer payslip. Employers should ensure that the paychecks are understandable for staff. They must clearly explain all amounts on the payslip. Employers may recieve a penalty if the pay slip is wrong or incorrectly presented.

Minimum wage pay via bank: Employers may not pay the minimum wage in cash. The mandatory cashless payment providing a bank statement that counts as an objective and transparent document. If an employee does not have a bank account, bank data will not transmit or they want to transfer their wages to an account that is not in their name, then the employer can not pay wages in a legal way. What an employee earns more than the minimum wage, may be paid in cash.

Minister Asscher indicated earlier this year that they want to change the rules of the minimum wage. That desire also lives in parliament: a majority wants a 'substantial' higher minimum wage. The government is preparing a proposal for amendment of the WML.
