Tweede Kamer wants more control over package deliverers

The Tweede Kamer (House of Representitives) has called for more verifification on whether package deliverers are self employed. The Kamer is concerned about the self-employed labourers who act as if theyhave been employed normally because they have to comply with many rules and PostNL obligations. Ultimately, the Kamer did not agree.

VVD MP Bas van 't Wout indicated this position, which caused frowns in Parliament. Coalition partner PvdA wondered if this kind of work has to be done by the self-employed. Parliamentarian Mei Li Vos fears “cut-throat competition on working conditions.”

Minister Asscher pointed out the limited role of labour inspection in the enforcement of post deliverers. Those cases may pass on to the tax authorities, but had few opportunities to intervene. The Minister expects that it will go better from May, when the Wet deregulering beoordeling arbeidsrelaties (Law on deregulation of labour relations review, DBA) comes into effect. This law replaces the old system independent of the VAR and must reduce appearance of independence within the workforce.
