New Legislation: Fixed Contracts and Easier Resignation

Just as we get used to the Work and Security Act, the new cabinet eases the redundancy rules. In addition, it is possible to offer a fixed employment contract only after three years. This will fix the forthcoming coalition labour legislation, which has just been enforced recently, reports the editorial board of RTL news today, which has had access to the Government Agreement.

Only after three years have a fixed contract

The new coalition finds the differences between fixed and temporary contracts too large. Therefore, the Rutte-III Cabinet wants the labour market to be such that more people who want fixed contracts can actually get it, read RTL news in the documents.

Under the WWZ (Dutch Dismissal Law), the term after which a fixed contract should be offered was shortened to 2 years. But the new cabinet will lengthen that term to three years. This should prevent employees from being suspended in a "rotary door of temporary contracts".

Longer probation is possible

The possibility of meeting a probationary period is also limited by the WWZ. But here too the new coalition provides relief to employers.

If an employer immediately offers an indefinite contract, a maximum probationary period of five months will apply. For employment contracts of two years or more, a probationary period of three months may be set.

Redundancy grounds combine again

One of the problems with the recently amended dismissal law is that employers must submit one substantiated dismissal ground to court. In the future, it will be possible to base the resignation on a combination of redundancies.

On the other hand, judges can grant a 50% higher dismissal allowance than it is now. Employees will also be entitled to severance pay from the start of their employment contract, rather than after two years.

Client statement for self-employed

Since the elimination of the VAR (Declaration of Labour Relationship), the current cabinet has made a mess of the rules for hiring self-employed workers.

The plan is now to issue a "Client Statement" via the Internet, which requires companies to provide clarity and certainty in the hiring of self-employed people. The statement replaces working with model contracts. In addition, the concept of "authority relationship" is clarified in the law, so that companies are more certain that someone who hires them is also really seen as self-employed.
