
On 29 November 2016, the European Directive (2014/66/EU), will be in force. The Directive concerns the conditions of entry and residence of third-country nationals in the framework of an intra-corporate transfer. From 29 November, employers should submit a residence permit application for intra-corporate transferees based on this Directive, and not as "Working as an employee" or "Working as a highly-skilled migrant".
There are specific conditions that apply to the new Directive category. For example, the transferee should have been employed within the same group of undertakings from at least three up to twelve uninterrupted months immediately prior to the transfer in the case of managers and specialists, and from at least three up to six uninterrupted months in the case of trainee employees. The maximum duration of one transfer to the Union, including mobility between Member States, should not exceed three years for managers and specialists and one year for trainee employees.
